SUMMARY
The role’s main purpose is to provide legal support regarding the Client’s compliance and information management function, particularly in relation to the Protection of Personal Information Act (POPIA) and the Promotion of Access to Information Act (PAIA). Thus, ensuring that all compliance-related matters are timely and appropriately identified, mitigated, and reported, to ensure the Client’s continuous compliance with relevant laws, regulations and internal policies.
RESPONSIBILITIES
Development of PAIA Manual
Receipt and management of PAIA requests
Analysis of PAIA requests and formulation of legally sound recommendations
Maintenance of PAIA request register and relevant activities
PAIA reporting
Liaison with the Information Regulator on PAIA matters
Provision of legal and administrative advice on PAIA
Development and maintenance of POPIA Management Framework and tools
Management of POPIA queries (internal and external)
Receipt, consideration, and administration of POPIA requests, complaints, and data breach notifications
Investigation of reported Data Breaches following policy
Maintenance of POPIA-related registers (operators, complaints, data breaches, requests, etc.)
Liaison with the Information Regulator on POPIA matters
Provision of legally sound advice on POPIA-related matters
Development and maintenance of CLIENT compliance framework and program
Support for the development and maintenance of CLIENT Regulatory Universe
Oversight of compliance risk management plans’ development and implementation
Development and implementation of compliance monitoring program
Compliance reporting
Conducting compliance awareness programs and related training
Providing legally sound compliance-related advice
MINIMUM REQUIREMENTS
LLB or equivalent degree.
Admitted Legal Practitioner.
A minimum of 3 (three) years post-qualification experience in a legal role.
Thorough knowledge and understanding of the PAIA and POPIA, with at least 2 years experience in dealing directly with relevant requests, processes and reporting.
Knowledge and understanding of the Compliance Institute of SA Compliance Framework.
Experience in legislative interpretation and implementation.
Proficiency in MS Office
The following would constitute an added advantage:
Compliance management experience
Certificate in compliance management
Registration with the Compliance Institute of SA
